Compliance

All construction work that is financed in whole or in part by CDBG funds is subject to Davis-Bacon Labor Standards and the Related Acts. In summary, the Davis-Bacon Act requires that all laborers and mechanics working on construction projects financed by the Federal government be paid the "prevailing wages" for each job classification. Davis-Bacon requirements govern all demolition and rehabilitation projects including those that alter or repair or public buildings and/or public works.
The Related Acts require that workers be paid overtime for all hours worked in excess of 40 hours a week, that employers do not compel workers to forfeit any portion of their wages, (except for permissible deductions,) and that employers submit weekly certified payroll reports.
A pre-construction meeting is required for sub-recipients with Public Facilities/ Infrastructure projects which will involve at a minimum the contract manager, prime contractor, and CDBG staff.
